§ 2.3. When sale or transfer of land by reference to plat prohibited.

No person shall sell or transfer such land or any part thereof by reference to, or exhibition of, or by any other use of, a plat of a subdivision before such plat has been duly recorded as provided herein, unless such subdivision was lawfully created prior to the adoption of a subdivision ordinance applicable thereto, provided that nothing herein contained shall be construed as preventing the recordation of the instrument by which such land is transferred or the passage of title as between parties to the instrument.
