§ 4. Information required on site development plan.

  • 4.1.

    A site plan, prepared, stamped and endorsed by a registered engineer, surveyor or other persons duly licensed by the Commonwealth of Virginia to practice as such, shall be submitted with every application for approval. A sufficient number of copies of the site plan shall be submitted, as the planning director shall require and shall contain the following information:

    A.

    Property and ownership information:

    1.

    A location map at a scale of not less than one inch equals 1,600 feet with the site plan clearly marked on the location map identifying the location of the property;

    2.

    Present recorded property owner and map book and page reference, deed book and page, or instrument number reference of the site property;

    3.

    Owners, lot numbers and map book/page or instrument number reference of all adjacent properties;

    4.

    A boundary survey of the parcel prepared at a scale of one inch equals fifty (50) feet or larger; no sheet shall exceed 24 × 36 inches in size. The survey shall include the acreage and/or square footage of the site and indicate all boundaries by course and distance;

    5.

    Iron pins 3/8 inch in diameter and 36 inches in length shall be shown and installed at all lot corners, points of tangents and any angle point along a given course of the parcel;

    6.

    All property information shall be certified by the engineer or surveyor of the project;

    7.

    Existing zoning;

    8.

    Geographical parcel identification number;

    9.

    Effective October 27, 1998, every site plan for a structure in the residential use group, as defined in the Virginia Uniform Statewide Building Code, containing any land located in an aircraft accident potential zone as designated on the geometric specifications and height limitations map and/or in noise zone greater than 75 dB Ldn, 70-75 dB Ldn, 65-70 dB Ldn or less than 65 dB Ldn, as designated on the city zoning map, shall delineate the boundaries of such zones and such site plan shall state as follows: "THIS SITE LIES WITHIN AIRCRAFT ACCIDENT POTENTIAL ZONE AND/OR NOISE ZONE(S) AND MAY BE SUBJECT TO AIRCRAFT ACCIDENTS AND/OR ABOVE AVERAGE NOISE LEVELS DUE TO ITS PROXIMITY TO AIRPORT OPERATIONS. NOISE ZONE ATTENUATION MEASURES FOR NEW CONSTRUCTION ARE REQUIRED IN ACCORDANCE WITH THE AIRPORT NOISE ATTENUATION AND SAFETY ORDINANCE AND HEIGHT RESTRICTIONS HAVE BEEN IMPOSED IN ACCORDANCE WITH SECTION 202(b) OF THE CITY ZONING ORDINANCE";

    10.

    An engineer's cost estimate for the construction of stormwater management facilities and all infrastructure located within the public rights-of-way and easements.

    11.

    All sites located in the special flood hazard areas shall provide base flood elevations and flood zone designation, per the Floodplain Ordinance (Appendix K) and the FIRM (Flood Insurance Rate Map).

    B.

    Existing and required site features and improvements:

    1.

    Streets and easements, their names, rights-of-way status (public or private), numbers and widths. Type (class) and width of pavement, curbs, and sidewalks.

    2.

    All property line and property line curve data or centerline and centerline curve data including radius, delta angle, length of arc, chord and tangent shall be shown on the site development plan.

    3.

    Utilities of all types.

    4.

    The topographic survey, showing the elevation of streets, alleys, buildings, structures, water courses and their names. The topography shall be shown by adequate spot elevations. The finished grade for the entire site shall be shown and the proposed lowest floor elevation of all buildings shall be a minimum of two (2) feet above the elevation of (a) the flood water of record of [or] (b) the intermediate flood level as determined by the U.S. Army Corps of Engineers or (c) the flood level shown on the Flood Insurance Rate Maps, whichever is greater. All elevations shall be referenced to North American Vertical Datum (NAVD) of 1988. All horizontal dimensions shown on the site development plan shall be in feet and decimals of a foot. All bearings in degrees, minutes and seconds. Additionally, on all residential site plans single-family, two-family, duplex and townhouses, the following information must be provided:

    a.

    The following statements and information shall appear on the site plan:

    (1)

    "The lot grading on this plan is in accordance with the latest subdivision construction plan submitted to and approved by the director of planning or his designee on (indicate date of approval)."

    (2)

    "The lowest floor elevation shown is two feet above the base flood elevation as adopted by the City of Virginia Beach."

    (3)

    The elevation of the curb (if existing or proposed) in front of each lot shall be indicated.

    (4)

    Elevations of the top of bank and toe of slope and limits of fill necessary to construct the dwelling unit, including access, shall be indicated.

    (5)

    "The proposed residential dwelling structure is not located in a special flood hazard area as determined by the National Flood Insurance Program Flood Insurance Rate Map (FIRM) Community-Panel No. ___ dated ______." for any residential lot located wholly or partially within the floodplains subject to special restrictions of section 4.10 of the Floodplain Ordinance (Appendix K) and recorded after the effective date of this ordinance ([October 23, 2001]).

    (6)

    "ALL OR A PORTION OF THIS SITE IS LOCATED IN A SPECIAL FLOOD HAZARD AREA, AS DETERMINED BY THE NATIONAL FLOOD INSURANCE PROGRAM FLOOD INSURANCE RATE MAP (FIRM) COMMUNITY-PANEL NO. _______ DATED _______," for any land located in the Special Flood Hazard Area, as shown on the most recently City Council adopted Flood Insurance Rate Map (FIRM) prepared by the United States Federal Emergency Management Agency.

    5.

    Number of floors, dimensions, and location of each building and proposed use for each building shall be indicated. If a multi-family, townhouse, or hotel development is submitted, a specific schedule showing the following information shall be included on the face of the plan:

    a.

    The dwelling units and/or lodging units per gross acre of the project;

    b.

    Breakdown of the number of bedrooms;

    c.

    Percent of parcel devoted to recreation. Provided further, if the breakdown of number of bedrooms should change prior to the issuance of a building permit, the builder or developer shall notify the city agent by letter of such change; if the number of units does not increase and if the dimensions or position of the building structures do not change then additional site plan approval will not be necessary.

    6.

    All off-street parking and parking bays, loading spaces and walkways indicating type of surfacing, size, angle of stalls, width of aisles and a specific schedule or the face of the site plan showing the number of parking spaces provided and the number required in accordance with the Virginia Beach zoning ordinance.     7.

    Existing and proposed storm drainage easements and the direction of drainage flow in streets, storm sewers, valley gutters, streams and ditches. Indicate all contributing areas in acres for storm drainage calculations as required by the Stormwater Management Ordinance [Appendix D]. Drainage area maps and drainage calculations shall be submitted to the city as a component of the site stormwater management plan in accordance with the Stormwater Management Ordinance [Appendix D].

    8.

    All existing and proposed water, sanitary sewer facilities indicating pipe sizes, types and grades shall be shown. Connections into existing or proposed central water and sewer systems shall be shown.

    9.

    Provision and schedule for the adequate control of erosion and sedimentation shall be in accordance with article III of chapter 30 of the Code of the City of Virginia Beach (City Code sections 30-56 through 30-78).

    10.

    Landscape design and land use buffer plan in accordance with the design standards of the department of planning, as approved by the council of the City of Virginia Beach, shall be required. Where Chesapeake Bay Preservation Areas are located on a site, landscaping design and buffer area plans shall be in accordance with Section 107 of the Chesapeake Bay Preservation Area Ordinance [Appendix F].

    11.

    A definite distance tie to an existing street intersection shall be provided.

    12.

    Location and identification of existing graves and objects or structures marking a place of burial shall be shown.

    13.

    For development or redevelopment having a construction footprint exceeding two thousand five hundred (2,500) square feet in Chesapeake Bay Preservation Areas, there shall, except if waived as unnecessary by the planning director, also be provided all elements of the plan of development as required by Section 107 of the Chesapeake Bay Preservation Area Ordinance [Appendix F] and the elements for Chesapeake Bay land disturbing activities in accordance with the Stormwater Management Ordinance [Appendix D]. The terms "development," "redevelopment" and "construction footprint" shall be as defined in section 103 of the Chesapeake Bay Preservation Area Ordinance. The term "Chesapeake Bay Preservation Act land disturbing activity" shall be as defined in Section 1-3 of the Stormwater Management Ordinance [Appendix D].

    14.

    Where required by Section 107 of the Chesapeake Bay Preservation Area Ordinance [Appendix F], there shall also, except if waived as unnecessary by the planning director, be provided a water quality impact assessment containing all of the elements required therein.

    15.

    The equivalent residential unit (ERU) calculations for existing and proposed horizontal impervious surface area rounded to the nearest tenth (0.1), shall be shown.

    16.

    Location and identification of wetlands.

    17.

    Location and identification of the floodplain.

    C.

    Hauling operations plans and information. In addition to the information required in subsections A. and B. of this section, where sand, gravel, topsoil, fill or other excavated material from the excavation of a stormwater management facility will be hauled off site, the following information shall be submitted to the city agent:

    (1)

    The names and addresses of all haulers;

    (2)

    If the hauler is a corporation, the name and address of its corporate offices and registered agent;

    (3)

    The proposed date on which the hauling operation will commence and the proposed date on which the operation will be completed;

    (4)

    The total number of cubic yards of material to be hauled;

    (5)

    The number, type, carrying capacity, and weight of vehicles to be used in the hauling operation on a daily basis;

    (6)

    The location of all haul roads leading to public streets and highways within the hauling area;

    (7)

    A statement listing the public streets to be used as haul routes to access an arterial or major street or highway;

    (8)

    A statement of the methods to be used to maintain or repair any public street or highway to be used for hauling purposes;

    (9)

    The location of the on-the-site haul road, the point at which the haul road intersects the public right-of-way, the nearest street intersections in all directions leaving the excavation site and all existing and proposed entrances on both sides of the public street within five hundred (500) feet of the proposed entrance;

    (10)

    A detailed description of the on-site haul road and the entrance to the public right-of-way, including width, radii, composition of surface material and length of improved surface;

    (11)

    Erosion and sediment control measures to be employed at the haul road entrance and all access points;

    (12)

    The method by which dirt and dust will be controlled on the public streets and in the air;

    (13)

    A traffic maintenance/control plan, including, but not limited to, sign type, size, color, lettering size and locations;

    (14)

    Location and description of public structures and improvements immediately adjacent to and under the haul road entrance; and

    (15)

    A description or plan of all proposed improvements to mitigate the traffic impacts associated with the hauling activity including, but not limited to, turn lanes, signalization, striping and other traffic control measures.

    (16)

    If the hauled material is to be deposited within the limits of the City of Virginia Beach, the address of the location where the hauled material will be taken and proof of current VPDES or VSMP permit coverage for the site where the material will be placed.

    The city agent shall determine the acceptability of the hauling methods and routes and may disapprove a site plan if:

    (1)

    Under accepted engineering standards, it is determined that the public streets and highways to be used in the proposed hauling route cannot sustain the weight or frequency of the hauling vehicles without substantial damage thereto; or

    (2)

    The proposed hauling operation would render the streets and highways affected by the hauling unsafe for public travel; or

    (3)

    The noise or dust generated by the hauling operation is of such character, intensity and duration as to be detrimental to the life or health of persons of reasonable sensitivity, or to disturb or annoy the quiet, comfort or repose of reasonable persons who reside in close proximity to the hauling operation; or

    (4)

    Any of the information required under this subsection is incomplete, incorrect or false.
