§ 23-42. Concealing, destroying, etc., city records.

  • (a)

    Whoever willfully and unlawfully conceals, removes, alters, mutilates, obliterates or destroys, or attempts to do so, or with intent to do so takes and carries away, any record, proceeding, map, book, paper, document or other thing filed or deposited in any public office of the city or with any public officer of the city shall be guilty of a Class 1 misdemeanor.

    (b)

    Whoever, having the custody of any record, proceeding, map, book, document, paper or other thing belonging to the city, willfully and unlawfully conceals, removes, alters, mutilates, obliterates, falsifies or destroys the same, or permits another to do so, shall be guilty of a Class 1 misdemeanor and, in addition shall forfeit his office and be disqualified from holding any office with the city.

    (c)

    Whoever having, or having had, access in an official capacity to any official record or report pertaining to any criminal investigation, including written documents, computer data and/or photographically recorded materials, who uses or knowingly permits another to use such record or report or portion thereof for any purpose not consistent with the exemptions permitted in section 2.1-342 of the Code of Virginia or other provision of state law or city ordinance, shall be guilty of a Class 2 misdemeanor.
